Terms of Use - WellSight

These Terms of Use (the "Terms") govern your use of the WellSight mobile application (the "App"). The App is developed and operated by Prayo ("Prayo", "we", "our", or "us"). By downloading, installing, accessing, or using the App, you agree to these Terms.

1. Eligibility

You may use the App only if you are legally permitted to do so in your jurisdiction. If you are under the age of majority in your jurisdiction, you should use the App only with the involvement of a parent or guardian.

2. What WellSight Does

WellSight is a digital wellbeing application that helps users maintain healthier viewing-distance habits while using a mobile phone. Features may include:

  • Distance monitoring using device sensors and front-camera-assisted estimation.
  • Too-close alerts and reminders.
  • App-specific monitoring and exclusions.
  • Continuous usage alerts and Focus Mode to reduce long, distracting sessions.
  • Voice reminders, Smart Alerts, and personal message alarms using custom TTS or recorded voice.
  • Reports and summaries based on app-monitored events.
  • Optional premium functionality available through Google Play billing.

3. Not Medical Advice

WellSight is not a medical device. It does not diagnose, treat, cure, or prevent any medical condition. Any feedback, warnings, or reports provided by the App are informational only and should not replace professional medical guidance.

4. License To Use The App

Subject to these Terms, Prayo grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the App for personal, lawful use on compatible devices you control.

5. Acceptable Use Restrictions

You agree not to:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App except where applicable law permits it.
  • Use the App in a way that violates applicable laws or regulations.
  • Interfere with the App's normal operation or security features.
  • Use the App in situations where inaccurate alerts could create unreasonable risk and you have not independently evaluated that risk.
  • Misrepresent the App as providing certified medical or clinical assessment.

6. Permissions And Device Features

The App may require permissions such as camera access, usage access, notifications, foreground service support, or overlay capability depending on which features you enable. This includes continuous usage alerts, Focus Mode, and personal message alarm features that rely on app-usage context or local audio playback. You are responsible for granting or revoking those permissions through your device settings. Some features may not work without them.

7. Premium Features And Billing

Certain features may require a paid subscription or purchase. Billing is handled by Google Play and is subject to Google's billing terms. Prayo does not directly process your payment card information. Premium entitlements may vary by offer, region, platform, and active billing status.

8. Data And Privacy

Your use of the App is also governed by the WellSight Privacy Policy. That policy explains how the App processes monitoring data, settings, diagnostics, and billing-related state.

9. App Performance And Limitations

You acknowledge that WellSight depends on device hardware, Android behavior, permissions, foreground service constraints, battery optimizations, OEM background restrictions, lighting conditions, app compatibility, and local audio behavior. Because of that, features such as continuous usage alerts, Focus Mode, and personal message alarms may not work identically on all devices or in all situations.

10. No Guarantee Of Continuous Availability

We do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with all devices, Android versions, or third-party services. We may change, suspend, or discontinue part of the App at any time.

11. Disclaimer Of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRAYO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF RESULTS.

12. Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRAYO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, LOSS OF USE, LOSS OF GOODWILL, OR LOSS OF PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE APP.

This includes situations where monitoring does not trigger, triggers too often, is interrupted by device restrictions, or does not perform as expected on a particular device.

13. User Responsibility

You are responsible for:

  • Reviewing whether the App is appropriate for your use case.
  • Managing your own device permissions and Android battery settings.
  • Choosing alert styles, including whether to use a personal message alarm instead of a generic alarm, in a way that fits your environment.
  • Evaluating whether alerts and reminders are suitable in your environment.
  • Using the App as a support tool rather than a guaranteed safety or medical system.

14. Intellectual Property

The App, its design, branding, code, text, graphics, and related materials are owned by or licensed to Prayo and are protected by applicable intellectual property laws. These Terms do not transfer ownership rights to you.

15. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate access to some or all of the App if necessary to protect the service, comply with law, or enforce these Terms.

16. Changes To These Terms

We may update these Terms from time to time. If we make material changes, we may update the effective date and provide notice through the app, website, or store listing where appropriate. Continued use after changes means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to applicable law, disputes arising from these Terms shall be brought before courts of competent jurisdiction in India.
